Possession Delays in Gurgaon: Statistics, HARERA Orders and Delay Interest Rates

By Aapt Dubey · Updated · 6 sources

A delayed Gurgaon buyer can claim interest from the builder at SBI's highest marginal cost of lending rate plus 2%, which works out to 10.95% a year for SBI's MCLR effective 15 October 2026, or take a full refund with the same interest. HARERA Gurugram has cleared all 2,174 complaints pending from 2018 to 2024, but enforcing orders is slower: only 371 of 1,064 execution cases were disposed of in FY 2024-25.

What interest does a builder pay for delayed possession in Gurgaon?

Under the Haryana RERA rules, the builder pays interest at the State Bank of India's highest marginal cost of lending rate (MCLR) plus 2%. SBI's highest MCLR is its three-year rate. It rose from 8.80% to 8.95% on 15 October 2026, so orders passed from now on should use 10.95% a year.

You can see the rule in action in HARERA's orders. On 29 September 2026 the authority directed Agrante Realty to pay 26 Kavyam buyers 10.80% a year from the due date of 20 August 2023, The Tribune reported, and described that rate as SBI's highest MCLR plus 2%. Orders in HARERA's FY 2024-25 annual report use 11.10%, and the FY 2023-24 report shows 10.85% and 11.10%.

The same rate applies the other way. A buyer who pays late owes the builder the same interest, so keep your own payments on time if you plan to claim.

How long are possession delays in Gurgaon?

The worst cases run to many years. In examples HARERA published in its FY 2024-25 annual report, a Centra One office unit in Sector 61 was due on 31 December 2011 and possession was offered on 19 November 2018, almost seven years late. In Neo Square, Sector 109, possession was due on 21 November 2013 and the occupation certificate came on 14 February 2019.

Affordable housing has its own share. Agrante's Kavyam in Sector 108 was due on 20 August 2023 under the 2013 affordable policy's four-year deadline. Before HARERA, the developer argued delivery should move to March 2026, citing about 129 days lost to GRAP construction bans; the authority kept the original due date.

We could not verify a current city-wide count of delayed or stalled units for Gurgaon from Anarock or PropEquity for this update, so we have not quoted one. The cases below come from HARERA's own records.

What can you claim if your flat is delayed?

Section 18 of the RERA Act gives you two choices. Stay in the project and claim interest for every month of delay until possession is offered, or withdraw and get your money back with interest from the date of each payment. HARERA's orders follow this pattern: in the Kavyam order, interest runs from the due date until offer of possession plus two months, arrears are payable within 90 days, and monthly interest is due by the 10th of each following month.

Compensation for mental harassment or loss is a separate claim before the Adjudicating Officer. That route is slower. In FY 2024-25 the Adjudicating Officer received 280 cases and disposed of 151, and total compensation awarded that year was ₹25.5 lakh.

In our experience, buyers who intend to take the flat usually do better claiming delay interest than a refund, especially when prices in the sector have risen since booking. If the builder is in financial trouble, the calculation changes and an early refund claim may be safer.

How fast does HARERA Gurugram decide delay complaints?

Around a year. The authority put its average disposal time at 12 to 15 months in April 2026 and said it wants that down to 6 to 9 months. It has cleared every complaint pending from 2018 to 2024, 2,174 in all, and decided 5,024 complaints in 2025.

Most of the backlog was recent. Of the 2,174 old cases, 1,060 were filed in 2024 and 654 in 2023, while only 15 dated from 2018.

Why do HARERA orders take so long to enforce?

Because winning is not the same as being paid. In FY 2024-25, 1,064 execution cases were filed with HARERA Gurugram and 371 were disposed of. In FY 2023-24 the figures were 1,023 filed and 294 disposed. Every year, far more buyers come back to enforce an order than get one enforced.

If the builder still does not pay, the matter goes for execution under Section 40 of the Act, and HARERA Gurugram runs a dedicated recovery cell. Before booking, check whether a developer has a long list of execution cases against it on the HARERA portal. It is a better warning sign than the number of complaints.

How to check a Gurgaon project for delay risk before booking

Start with the HARERA registration page for the project. It shows the completion date the promoter declared, any extensions granted and the quarterly progress reports. A project that has asked for an extension, or whose reports have stopped, needs a hard look.

Next, search the authority's complaint and execution lists for the promoter's name, not just the project. Builders with delays elsewhere tend to repeat them. Then ask the bank: lenders that have approved a project have done their own checks, and a project no major bank will fund is telling you something.

Finally, read the possession clause in the agreement. HARERA counts delay from the due date written there, so a vague or very long grace period weakens your claim. If you would rather not take construction risk at all, a ready-to-move flat with an occupation certificate removes the question entirely.

What help exists for stalled projects?

At national level, HARERA Gurugram's FY 2024-25 annual report notes that the Union Cabinet approved a ₹25,000 crore alternative investment fund to revive around 1,600 stalled housing projects, and that Budget 2025 allotted ₹15,000 crore to the second phase of the SWAMIH fund for stalled affordable and mid-income projects.

Locally, HARERA said in February 2020 that it had helped restart 250 housing projects in its first two years, with construction continuing under its supervision, and its latest report says it inspects ongoing and stalled projects on site. If your project has stopped, file with other buyers rather than alone: a joint complaint with a common due date is heard together, as the 26 Kavyam complaints were.

Frequently asked questions

SBI's highest MCLR plus 2%. That was 10.80% for most of 2026 and becomes 10.95% for SBI's MCLR effective 15 October 2026.

Interest at the prescribed rate on the amount you have paid, for each month from the due date of possession until the builder offers possession plus two months, or actual handover if earlier. HARERA used exactly this formula in its September 2026 Kavyam order.

Yes. Under Section 18 you can withdraw and claim a refund with interest from the date of each payment. In one FY 2024-25 order HARERA directed a refund of ₹69.34 lakh with 11.10% interest for a unit delayed about seven years.

About 12 to 15 months on average as of April 2026. All complaints filed up to 2024 have been decided.

File an execution petition with HARERA. In FY 2024-25, 1,064 execution cases were filed and 371 disposed of, so enforcement takes time; unresolved matters are referred for execution under Section 40 of the Act.

Builders often claim it. In the Kavyam case the developer cited about 129 days lost to GRAP, but HARERA still held the due date of 20 August 2023 and ordered delay interest.

Yes, compensation is a separate claim before the Adjudicating Officer. It awarded ₹25.5 lakh in total in FY 2024-25 across the cases it decided.

How we compiled these figures

The delay interest rate series is our calculation from SBI's published MCLR history (three-year tenor, the highest) plus 2 percentage points, which is the rate the Haryana RERA rules prescribe; we checked it against rates used in HARERA orders. Case examples and execution figures are from HARERA Gurugram's annual reports for FY 2023-24 and FY 2024-25. Backlog figures are from The Tribune's April 2026 report of the authority's data. We did not find a verifiable current count of stalled units for Gurgaon in this update and have not estimated one. We update this page quarterly and whenever SBI changes its MCLR.
